PRIVACY POLICY

IN SPIRIT DESIGN S.L. guarantees the protection of all personal data provided by the User on the Website and, in compliance with the provisions of Organic Law 3/2018, of December 5, on Personal Data Protection and guarantee of digital rights.

All personal data provided to IN SPIRIT DESIGN S.L. will be processed by it in accordance with Organic Law 3/2018, of December 5, on Personal Data Protection and guarantee of digital rights and will be included in the corresponding register created and maintained under the responsibility of the Data Controller.

IN SPIRIT DESIGN S.L. respects the current legislation on the protection of personal data, user privacy and the secrecy and security of personal data, in accordance with the provisions of the applicable data protection legislation, specifically Regulation 2016/679 of the European Parliament and of the Council of April 27, 2016, and Organic Law 3/2018, of December 5, on Personal Data Protection and guarantee of digital rights, adopting the necessary technical and organizational measures to prevent the loss, misuse, alteration, unauthorized access and theft of the personal data provided, taking into account the state of the technology, the nature of the data and the risks to which they are exposed.


I.- Who is the Data Controller of your data?

This privacy policy (hereinafter, the “Privacy Policy”) applies to all personal data that the user provides to IN SPIRIT DESIGN S.L., which is the entity that owns this website (hereinafter, the “Website”), with registered office at Calle Edgar Neville 6, 28020, Alcobendas, Madrid, and with Tax ID No. B83190579, and whose main activity is nan.

For the purposes of this Privacy Policy, “User” shall be understood as any natural person interested in the products and services that IN SPIRIT DESIGN S.L. offers through its Website.

IN SPIRIT DESIGN S.L. will request, prior to the provision of personal data, the User’s express consent to this Privacy Policy, when necessary, and to any other matter requiring prior authorization.

The User may contact us via email at legal@inspiritdesign.es for any questions or needs related to data protection.


II.- For what purpose do we process your personal data?

The User is hereby informed that IN SPIRIT DESIGN S.L. will process personal data for the purposes indicated below, insofar as there is a legal basis for each processing activity, as explained later:

(a) To guarantee the User access to and use of the Website, as well as for the management, study and resolution of inquiries.
(b) To facilitate the User’s relationship with IN SPIRIT DESIGN S.L. and, where applicable, the contracting of a service.
(c) To inform the User by any means, including sending commercial communications and commercial prospecting to the email address that the User may provide to IN SPIRIT DESIGN S.L., of documentation about the company, its activities, products and services, as well as documentation of various kinds.
(d) To comply with legal obligations with different Public Administrations and Institutes.

Unless expressly stated otherwise, it is mandatory to provide all requested Personal Data, without which it will not be possible to provide information on the activities and services of IN SPIRIT DESIGN S.L.

The data are collected in order to make it possible to provide information about the products and services of the Company/Self-employed. If the User has given express consent for this, the data may also be used to send commercial information about offers and discounts from the Company/Self-employed.


III.- What is the legal basis for processing your personal data?

The legal basis for processing data for purposes (a) and (b) is the necessity for the execution of a contract to which the data subject is a party or for the application, at their request, of pre-contractual measures; for (c) it is the consent requested from the User in the corresponding form; and for (d) it is a legal obligation.

If the data are necessary to respond to an inquiry or manage the contracting of a product or service and are not provided completely, it is warned that this may not be carried out satisfactorily.

At the time personal data are provided, IN SPIRIT DESIGN S.L. will collect and process only those that are essential for the accepted purposes.

Under no circumstances will IN SPIRIT DESIGN S.L. transfer, exploit or use these data for purposes other than those expressly indicated herein.

The User may voluntarily provide additional information that allows the service to be personalized. The decision to supply such information rests exclusively with the User, who must give express consent for its use and may revoke it at any time.


IV.- How long do we keep your personal data?

IN SPIRIT DESIGN S.L. will retain Users’ data during the contractual relationship with the user and, in any case, for a maximum period of two years from the last time the User interacted with IN SPIRIT DESIGN S.L., or until the User revokes consent, without prejudice to the retention that may be necessary for the formulation, exercise or defense of potential claims and/or whenever permitted by applicable legislation during the statutory limitation periods, and/or those established in applicable regulations after the termination of the contractual relationship. Once this period has ended, the Company undertakes to cease processing all data and, where appropriate, to duly block them in the corresponding Company databases.

Data will be blocked when rectification or deletion is requested. Blocking data consists of identifying and reserving them, adopting technical and organizational measures to prevent their processing, including visualization, except for making them available to judges and courts, the Public Prosecutor’s Office or the competent Public Administrations, in particular data protection authorities, for the enforcement of possible liabilities arising from the processing, and only for the limitation period thereof. After this period, the data must be destroyed. Blocked data may not be processed for any purpose other than that indicated above.


V.- Security and integrity of personal data. Who has access to your personal data?

We establish the required security levels for our employees to preserve the protection and integrity of the data of our clients and interested parties. This Policy seeks the adoption of actions aimed at preserving the four basic components of information security:

– Confidentiality: We allow access to data and systems only to duly authorized persons, following the “need-to-know” principle.
– Integrity: We preserve the accuracy of information and systems against any type of alteration, loss or destruction, whether accidental or fraudulent.
– Availability: We establish the necessary mechanisms so that information and systems can be used in the required manner and time.
– Auditability: We enable any action or transaction to be uniquely traceable, ensuring compliance with key controls established in the corresponding regulations.

In addition to the above, the User understands that IN SPIRIT DESIGN S.L. may carry out transfers or communications of personal data to comply with its obligations with Public Administrations when required by current legislation and, where applicable, also to other bodies such as State Security Forces and Corps and Judicial bodies.

The security of your data is very important to us. We have designed a continuity plan to minimize the impact that any contingency affecting service provision may have on our clients.

We will use appropriate resources to investigate security breaches that endanger the privacy of our clients and interested parties, ensuring that appropriate corrective measures are implemented. We will keep a record of security incidents available to local supervisory authorities.

We will inform our clients of relevant cases in which the loss, misuse or disclosure of information has been caused by a breach in the security of the company’s systems and networks or derived from an internal technical decision or action. In such cases, we will inform clients of the corrective actions taken and provide appropriate recommendations to help protect their interests.


VI.- What rights do users have?

IN SPIRIT DESIGN S.L. informs the User of the possibility of exercising, free of charge, the rights of access, rectification, opposition, deletion, portability and limitation of processing, as well as rejecting automated processing of personal data, by means of a written and signed request addressed to: legal@inspiritdesign.es or to the registered office of IN SPIRIT DESIGN S.L., indicating contact details and the reference: “Data Protection. Exercise of LOPD rights,” which must include: name and surname, photocopy of ID card (passport or other valid identification document), the request specifying the application, address for notifications, date and signature.

The User has the right to object to the processing of their data for promotional purposes for receiving commercial communications by simply notifying IN SPIRIT DESIGN S.L. of their intention. To do so, the User may submit the request using the procedure described above. Likewise, the User may cancel the receipt of commercial communications in the manner provided in each communication.

In addition to the above rights, the User has the right to withdraw consent at any time using the procedure described above, without such withdrawal affecting the lawfulness of processing prior to withdrawal. IN SPIRIT DESIGN S.L. may continue to process User data insofar as permitted by applicable law.

IN SPIRIT DESIGN S.L. reminds the User that they have the right to file a complaint with the Spanish Data Protection Agency.


VII.- Data quality

IN SPIRIT DESIGN S.L. warns the User that, except in cases of legally constituted and accredited representation, no User may use another person’s identity or communicate their personal data. Therefore, the User must always bear in mind that they may only provide personal data corresponding to their own identity that are adequate, relevant, current, accurate and truthful. For these purposes, the User shall be solely responsible for any direct and/or indirect damage caused to third parties or to IN SPIRIT DESIGN S.L. by the use of another person’s personal data, or their own personal data when they are false, incorrect, outdated, inadequate or irrelevant.

Likewise, the User who communicates personal data of a third party shall be responsible to that party for the duty to inform when personal data have not been collected from the data subject, and/or for the consequences of not having informed them and, where applicable, obtained their consent.

If the User provides any personal data of third parties, they undertake to inform those persons in advance of the intention to communicate their data to IN SPIRIT DESIGN S.L. and to obtain their prior, express and written consent for such data processing and any purposes for which they are to be processed, the User being responsible otherwise.

The User is, in principle, the sole source of information for their personal data. Therefore, IN SPIRIT DESIGN S.L. requests that, in order to keep data updated at all times in accordance with the principles of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 (GDPR), any changes be communicated to the registered office of IN SPIRIT DESIGN S.L. or to the email address: legal@inspiritdesign.es. The User is reminded that to update their data they must prove their identity by providing a photocopy of their ID card or equivalent document.

The company will NOT make automated decisions, profiles or logic applied to your data and will only transfer your data to third parties, if necessary to achieve the purpose of processing, after informing you in advance and with your consent.

In the collection and processing of Personal Data, the necessary technical and organizational measures will be adopted to guarantee the security of Personal Data and prevent their alteration, loss, unauthorized processing or access, taking into account the state of the technology, the nature of the data provided and the risks to which they are exposed, whether from human action or from the physical or natural environment.
